Terms of Service

Plain-language summary

  • Waypoint EF is an observation and documentation tool — not a substitute for professional evaluation
  • We never store more than nickname + age band for your child

  • We are not responsible for how schools respond to your evidence summary
  • You must be 18+ (or a teen 13+ with parental consent) to use the Service

1. What Waypoint EF Is

Waypoint EF (“the Service”) is a home executive-function practice and documentation platform. It helps parents and guardians (or teens 13+) log daily structured activities and compile observation-based evidence summaries and evaluation-request letters.

The Service is NOT:

  • A substitute for professional evaluation by a qualified clinician
  • A provider of assessments, or clinical recommendations
  • A creator of IEPs, 504 plans, or EHCPs — those are legal documents created by school teams
  • A guarantee that schools will accept your documentation or approve evaluations

2. Eligibility

  • Parents/guardians: You must be 18 or older and the legal parent or guardian of the child whose activities you log.
  • Teens (13–18): May use the Service with verified parental consent and their own assent. Teen-initiated signup only.
  • Children under 13: May not use the Service directly. Parents log activities on their behalf.

3. Account and Data

  • One account per email address.
  • You are responsible for maintaining access to your email for OTP login.
  • All data you enter (logs, notes, child profiles) belongs to you.
  • You may export all your data at any time (JSON format).
  • You may delete all your data at any time (hard-delete, 30-day SLA).
  • We retain consent records for 3 years after deletion for legal compliance.

4. Acceptable Use

You agree not to:

  • Use the Service for any child you are not legally authorized to represent.
  • Enter false information about your relationship to the child.
  • Use the Service to fabricate or misrepresent observation data.
  • Attempt to access another family’s data.
  • Use automated tools to scrape, crawl, or overload the Service.
  • Redistribute the letter builder output as your own product or service.

5. The Letter Builder

The evaluation-request letter builder is a free educational template tool. The letter is generated in your browser as you type. If you ask us to email you a copy, the letter text and your email address are transmitted to our email provider solely to deliver that one message — we do not store the letter content.

The letter templates are based on IDEA (Individuals with Disabilities Education Act) requirements. They are educational tools, not legal advice. Consult an attorney or advocate if you need legal counsel about your child’s educational rights.

6. Evidence Summaries

Evidence summaries are generated from your self-reported observation data. They reflect what you logged — not an independent assessment of your child.

We make no guarantee that any school team or evaluator will accept, rely upon, or act on your evidence summary. Schools make evaluation decisions independently under their own legal obligations.

7. Payments and Refunds

  • Pilot pricing: $49 one-time (subject to change).
  • Payments processed by Stripe. We never see or store your card number.
  • Refunds are available within 3 days of purchase — self-serve from your account settings, or by email. After 3 days, contact support and we will review requests case by case.
  • The letter builder is free and does not require an account.

8. Limitation of Liability

To the maximum extent permitted by law, Waypoint EF and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service, including but not limited to: school evaluation outcomes, decisions made by school teams, reliance on evidence summaries, or delays in the evaluation process.

Our total liability for any claim arising from the Service shall not exceed the amount you paid us in the 12 months preceding the claim.

9. Disclaimers

The Service is provided “as is” without warranties of any kind. We do not warrant that the Service will be uninterrupted, error-free, or that evidence summaries will achieve any particular outcome.

10. Changes to These Terms

We may update these Terms. Material changes → email notification before they take effect. Continued use after changes = acceptance.

11. Governing Law

These Terms are governed by the laws of the State of Delaware, without regard to conflict of law principles.
